In a divorce case, I first try to see whether or not a separation agreement is possible
A separation agreement is an agreement by the parties on the issue that presents itself for that divorce. Some of these issues are,
- Grounds for divorce
- Child custody
- Child support
- Visitation
- Alimony
- The family home
- Distribution of property
- Allotment of debt
Each issue that is resolved by agreement, doesn't have to be litigated, and works to lower the cost of litigation.
In Guardianship and Name Change Cases, I Seek Agreement
If there's an agreement on the issues in guardianship and name change cases, I can charge a flat fee. If there's no agreement, I ask for a retainer (an advance from which I can bill against, at an hourly rate).
I also prepare wills, living wills, powers of attorney, durable powers of attorney, and deeds, for flat fees.
